Why is this in the 'open source tab' when its not open source?

A Drawn 2 Life clone made with gamemaker.
The player can draw the body parts of his character and they are automatically animated in the game. Includes saving and loading models.
The source is included in the download along the example models in the 'Models' folder. The character editor is a bit slow since EVERYTHING is being draw with code, not objects in the room editor.
please give credit to Alejandro Ramallo if you use this, I worked really really hard on this :)
